Terms of Use

1. Parties

The authoritative version of these Terms is in Turkish (/kullanim-kosullari), which governs in the event of any conflict.

2. Service Description

Yaverin is a SaaS platform that enables small and medium-sized businesses to provide AI-assisted responses to their customers on WhatsApp Business and Instagram Direct, route conversations to human team members when appropriate, and integrate with their existing business data.

Yaverin operates subject to the API policies of third-party messaging platforms (Meta/WhatsApp, Instagram). Changes to those platforms may affect the scope of the service.

3. Acceptance

By accessing the platform, creating an account, or using the service, you agree to these Terms in full. If you do not agree, please do not use the service.

4. Account and Access

• You must be 18 or older, or an authorized representative of a business entity, to create an account.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You must notify us immediately at hello@yaverin.com of any unauthorized access or security breach.
• You may not transfer or sub-license your account to another party.

5. Prohibited Uses

The following are prohibited when using Yaverin:

• Transmitting or distributing unlawful content
• Sending spam, misleading messages, or engaging in phishing
• Reverse-engineering, decompiling, or attempting to extract the source code of the platform
• Taking actions that threaten the security or integrity of the platform
• Violating WhatsApp Business or Instagram API policies
• Processing third-party personal data without appropriate authorization
• Reselling or sublicensing the service without prior written consent

6. User Content and Data

Content you upload to the platform (knowledge base, product data, policies) remains yours. You grant Yaverin a limited license to use this content solely for providing the service.

You are responsible for ensuring that your processing of your end-customers' personal data complies with applicable law, including KVKK. Yaverin acts as data processor for such data.

7. Intellectual Property

The Yaverin platform, software, brand name, and logo are owned by [COMPANY NAME] and protected by applicable intellectual property law. These Terms do not grant you any rights in those assets.

8. Limitation of Liability

Yaverin does not warrant that the service will be uninterrupted or error-free. The platform is provided "as is."

To the maximum extent permitted by applicable law, Yaverin is not liable for indirect, incidental, special, or consequential damages. Yaverin's total liability is limited to the subscription fee paid by you in the month in which the damage arose.

The accuracy of AI-generated responses is not guaranteed. Merchants are responsible for monitoring the responses delivered to their customers.

9. Suspension and Termination

Yaverin may suspend or terminate your account without prior notice upon a material breach of these Terms or violation of third-party platform policies.

You may close your account at any time. The subscription fee for the current period is non-refundable upon closure. Your data will be deleted after the retention period specified in the service terms.

10. Changes to Terms

Yaverin may update these Terms. Material changes will be communicated at least [X days] in advance by email or in-platform notification. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul have exclusive jurisdiction over any disputes arising from these Terms.
